HC disapproves of delay in remission

Justice K. Lakshman of the Telangana High Court reprimanded Ravi Gupta, principal secretary, home (Prisons), for not effectively dealing with the remission of a life convict on the ground that the file is pending with the Governor. The official was directed to pursue the matter with the Governor and appraise Raj Bhavan of the timeline fixed by the apex court on the disposal of petitions filed by life convicts. The judge also directed the authority to take steps to ensure the release of the convict, Md Sarwar, by August 15. Justice Lakshman was dealing with a contempt case filed by Md. Sarfaraz on the non-release of his father, Md Sarwar. In an order on June 1, 2021, the judge had made it clear that Md Sarwar be considered for remission based on guidelines and principles laid down by the apex court. The issue at hand was whether remission should be granted to a convict in a case of murder when the victim was a public servant on duty; the court earlier had recorded that the victim, a deputy secretary of the AP State Board, was not on duty. This fact was reconsidered, and remission was disallowed on the same ground. This, the petitioner pointed out, was in contempt. Pushpender Kaur, counsel for the petitioner, also pointed out that having sent up recommendations, the government cannot be a mute spectator to the delay if any.
