Forum directs promoter to hand over villa to purchaser
Chennai: The District Consumer Disputes Redressal Forum, Chennai (South), has directed a residential house promoter to complete construction of a villa in two months and hand it over to the person who paid the entire cost of Rs 40 lakh to the firm three years ago.
The forum also directed that an interest of 18 % per annum for Rs 40,41,250 from October 2013 till the date of delivery of the villa be paid to him. In the complaint, B.Vinod Bala, Athipet, Chennai, submitted that he booked a villa in residential colony — “Centurion Avenue”, which was proposed to be constructed by Green Avenue Homes and Gardens, TTK Road, Alwarpet.
He paid an advance amount of Rs 1 lakh in July 2012 for development of the land for construction of the flat. The firm allotted him a flat with the land. A sale agreement for the purchase of plot was registered in November 2012. Based on this, he availed LIC housing loan and payment was directly released by LIC to promoters. The firm received Rs 40.41 lakh against the total agreed sum of Rs 41.95 lakh. As per the agreement, the firm agreed to deliver the constructed villa to him in October 2013.
Despite repeated requests, the promoters had not completed the villa construction and not delivered it to him. He contended that the act amounted to deficiency of service.
