Madras High Court notice on registration of house sites

Which imposes restrictions on registration of certain types of immovable properties.

Chennai: An advocate has approached the Madras high court to declare as unconstitutional, the proviso to the amended section 22-A (2) of the Tamil Nadu Registration Act, which imposes restrictions on registration of certain types of immovable properties.

A division bench comprising Chief Justice Sanjay Kishan Kaul and Justice R. Mahadevan before whom the public interest litigation filed by V.B.R. Menon came up for hearing, ordered notice to the state government and inspector general of registration and posted to November 16, further hearing of the case.

According to Menon, the state government had notified Act 2 of 2009 by which section 22-A of the Registration Act had been amended with effect from October 20, 2016. As per the amendment, different categories of documents which were listed under section 22-A shall be refused for registration on presentation to the concerned registration authorities. He said the proviso will create a situation in which a section of owners of plots in an unauthorized lay out would be discriminated against others.
