Mohammad Fazal kin sabotaged probe: CBI
Kochi: The Central Bureau of Investigation (CBI) probing the murder of NDF worker Fazal in Thalasserry on Friday submitted before CBI court that victim's brother has colluded with accused persons to sabotage the investigation. The CBI made the submission in a petition filed by Fazal's brother Sathar seeking further investigation by the CBI in the case. RSS activist Subeesh had made a confession to the Kerala police that Fazal was murdered by RSS workers and not by CPM workers who were chargesheeted by the CBI. Subeesh, meanwhile, denied his involvement in the murder case.
Mr Sathar filed a petition seeking further investigation after the “confession” was leaked out. However, the CBI stated that the statement given by Subeesh was fabricated and that it cannot be taken into consideration by the court. The investigating agency maintained that the probe has been completed and the court has accepted the chargesheet it filed. The CBI submitted that Subeesh had written a letter to the CBI director denying his involvement in the case. However, counsel appearing for Mr Sathar stated that Mr Subeesh did not report any custodial torture while he was taken to magistrate court after making the confession in police custody.
Subeesh, meanwhile, denied his involvement in the case and filed a petition before the CBI court in Kochi on Friday, claiming that he was tortured brutally in police custody and was forced to accept his involvement in the case. He has also filed a complaint against two police officials involved in custodial torture at a magistrate court. He also has approached the National Human Rights Commission against the police personnel behind the act. The CBI stated that there are contradictions in the statement made by Subeesh and the facts disclosed during its investigation. As per his statement, the murder of Fazal took place at 1.30 am but CBI investigation revealed that the murder took place around 3.30 am. Fazal was murdered in October 2006, at Thalassery. The CBI, after taking over the probe from Kerala police, chargesheeted 8 CPM workers.
