Withhold names of those selected for PD posts: HC

HYDERABAD: A two-judge bench of Telangana High Court on Monday directed authorities not to announce the final list of selected candidates for the posts of physical director. The bench, comprising Chief Justice Ujjal Bhuyan and Justice N. Tukaramji, was dealing with a writ plea filed by Devulapalli Mahesh Kumar and 64 others. The petitioners questioned the notification issued by the secretary, TS Public Service Commission prescribing qualifications for the post of physical director. They complained that the notification was illegal and contrary to NCTE Regulations 2014. The petitioners contended that a direction be given to continue the recruitment process with persons who were eligible as per the NCTE Regulations 2014 and allow petitioners who completed MP Ed to participate in the selection process. The bench while relying on an earlier order passed by it said that there was no such requirement for securing additional post graduate degree to qualify as a physical director and permitted the petitioners to apply for the said post.

HC terms cancellation of GST registration as illegal

A two-judge bench of Telangana High Court on Monday heard a writ plea questioning the cancellation of GST registration. The bench, comprising Chief Justice Ujjal Bhuyan and Justice N. Tukaramji, was dealing with a writ plea filed by Sri Lakshmi Home Appliances. The petitioner questioned the cancellation of the GST registration by the additional commissioner of central tax and GST appeals. The petitioner contended that the registration was cancelled on the pretext that no returns were filed on its behalf for six months. In fact, a showcause notice was issued and a reply was given by the petitioner. However, holding that the reply was not satisfactory, the GST registration was cancelled and an appeal was also rejected. The bench held that the orders of cancellation of GST was illegal and remanded the matter back for fresh hearing. It also gave liberty to the petitioner to submit the returns at the time of hearing.

HC takes up plea questioning continuation of illegal mining

A two-judge bench of Telangana High Court on Monday heard a writ petition questioning the failure of authorities in curbing illegal mining. The bench comprising Chief Justice Ujjal Bhuyan and Justice N. Tukaramji was dealing with a petition filed by Maddela Dinesh and others. The petitioners questioned the failure of the central and state Pollution Control Board, and Singareni Collieries in failing to take steps against the illegal mining being carried out by Kutch-based PC Patel Infra. The petitioners complained that the mining operations being carried out were contrary to the guidelines enumerated in environmental clearance and sought an end to it. The bench directed a notice to the company and posted the matter to March 23 for further hearing.

Anticipatory bail plea rejected in abetment to suicide case

Justice C. Sumalatha of Telangana High Court on Monday denied anticipatory bail in a petition filed pertaining to abetment of suicide. The petition was filed by Nalla Madhukar Reddy of Kamareddy. He contended that paddy worth Rs 2.5 lakh was purchased from him by one Lingaiah, a farmer from the same village. Several requests for repayment, evoked no response from Lingaiah due to economic problems. Unable to bear Madhukar’s torture, Lingaiah came to the petitioner’s house and died by suicide. The body of the deceased was allegedly dragged to a nearby temple where passers-by informed Lingaiah’s son. Keeping in mind the manner in which Lingaiah had resorted to such an action, the judge refused to grant Madhukar Reddy anticipatory bail at this stage.
