Telangana High Court dismisses UoH plea against govt on trespass of varsity land

Hyderabad: In a setback to University of Hyderabad (UoH) over the dispute with the state government on laying a 36-metre master plan road through the university land connecting ISB and Serilingampalli, the Telangana High Court dismissed the plea of the university, which wanted directions to the government and GHMC not to trespass into its land.

Justice Shameem Akther ruled that there were no merits in the contentions raised by the University.

“Viewed from any angle, it is not a fit case to grant the relief sought for. The writ petition is devoid of merit and is liable to be dismissed,” he ruled.

The Judge said that though it was handed over cs.2324.05 guntas of land in Sy.Nos.1 to 9, 14 to 24 and 25 of Kancha Gachibowli Village, Serilingampalli mandal in 1974 to establish university campus, there is no documentation for alienation of the said land.

“On the other hand, a serious dispute is raised by the government that the land was not allotted to the petitioner university and there is no GO or conveyance deed in this regard,” the court said.

The court said that the dispute involves complicated questions of fact, which require a regular and full-fledged trial. In the circumstances, it is left to the university to work out the remedies before the competent civil court.

Earlier, the court had issued interim orders restraining private parties from using the said road as it could impact safety and security of those residing in the varsity campus.
