Kerala High Court throws out Saritha Nair plea for CBI inquiry

She alleged that Oommen Chandy being CM of the state the investigation by the state police would not be proper.

Kochi: Kerala High Court on Monday heavily criticised solar scam accused Saritha S Nair for filing a plea seeking CBI probe against CM Oommen Chandy in the the controversial scam. Questioning Saritha's credibility the court termed Saritha's move as 'politically motivated'. To make a claim of unfairness and malafide in an investigation the person making such a claim should have a credibility.

Throwing out the plea the court further observed "can a person who is an accused in 33 criminal cases, for allegedly squeezing crores of rupees from different persons of the public, claim such a credibility?" Justice B Kemal Pasha made it clear that Saritha cannot make use of the court room as a platform for playing politics when the assembly election are at the door step. Saritha argued that police had registered the case against Saritha, Biju Radhakrishnan and Tenny Joppen former member of CM's personal staff on the basis of a complaint filed by Sreedharan Nair from Konni.

According to Saritha Oommen Chandy was also a party to the transactions and, therefore, the investigating agency should arraign him as an accused. She alleged that Oommen Chandy being CM of the state the investigation by the state police would not be proper.

Both Advocate General K P Dandapani and Director General of Presecution T Asaf Ali appeared for the state and vehemently opposed the plea. AG pointed out that even a plea filed by oppostion leader V S Achuthanandan was dismissed by a division bench seeking CBI investigation. DGP meanwhile pointed out that the plea is a politically motivated. Court recorded both the submissions.

Court also observed that it is very strange to see that even now the complainant-Sreedharan Nair has not come forward with a complaint that Chandy had been exonerated by the investigating officer in the case.
