Shamna death: Kerala High Court stays probe on Dr Jilse

The report had indicted two senior doctors for negligence in the case.

Kochi: Kerala High Court has stayed the probe against Dr Jilse George, head of the department of general medicine at the Kalamassery Medical College, an accused in the death of Shamna Thasneem, a student there. The court stayed the case probed by Crime Branch for one month. Dr Jilse moved the court alleging that the report filed by the state level apex body appointed to investigate the matter is wrong. He argued that the probe based on the false report is not fair and an abuse of law.

The report had indicted two senior doctors for negligence in the case. The petitioner pointed out that it had now forwarded the report to the investigation officer. The report concluded that there was medical negligence on the part of the doctors who were on duty on July 18, 2016, and there was negligence on the part of the petitioner and the head of the department of general medicine.

Jilse argued that its constitution was against the decision of the apex court. There was no expert or specialist on the panel. No reason whatsoever had been stated by the Apex Body in arriving at a different finding from that of the District Level Expert Committee. It was biased. Therefore, if the investigation officer were to proceed by the report, it would lead to the miscarriage of justice, his pleaded.
