SHRC orders cops to pay fine of Rs 50,000

Chennai: The State Human Rights Commission has directed two inspectors to pay a compensation of '50,000 to an elderly person and a woman on a charge of illegally arresting and detaining them in a false case eight years ago.
In a petition, Shobana Kumari said her husband Dr P. Vijayakumar was running an Ayurvedic Vaidyasalai, Travancore Raja Vaidya Salai at Mylapore, and elder son Jagadeesh Kumar and his wife Anila were also BAMS qualified Ayurvedic doctors.

Based on a false complaint from Rajammal, Raghupathi, inspector (Crime), Mylapore police station, registered a case against Dr P. Vijayakumar. Rajammal alleged that her treatment rendered by Dr P. Vijayakumar was not successful and she sought a refund of her payment. Subsequently, 26 cases were foisted against the doctor.

Fearing arrest, Jagadeesh Kumar and Anila obtained anticipatory bail. In an effort to locate the couple, the cops took her other son Vijaya Bishmar, who was a final year BAMS student, under their custody on March 19, 2010.

They went to Trivandrum and arrested their relative Sudhir Kumar, 50, Sujatha, a widow at gunpoint and detained them in their illegal custody. They were brought to Chennai from Trivandrum by train and illegally detained them at the Mylapore police station and harassed them.

A day later, a false case was registered against them April 9, 2010, for harbouring the offenders.

In its reply, the inspectors submitted that Shobana Kumari was making a false and baseless complaint. The accused, Jagadeesh Kumar and his wife were absconding and on April 1, 2010, Vijay Bhishmar was called for an enquiry to know the whereabouts of the absconding accused. Later, he was let off on the same day.

Judge D. Jayachandran said there is no necessity to arrest, detain and remand Sudhir Kumar and Sujatha in a criminal case. They suffered humiliation at the hands of the inspectors, which amounted to the violation of their rights, personal, liberty. The inspectors are liable to pay a total compensation of Rs 50,000.
