HRC faulted for role in land disputes

HYDERABAD: The Telangana High Court on Wednesday faulted Telangana State Humans Rights Commission (TSHRC) for its involvement in disputes related to properties.

A division bench, comprising Chief Justice Alok Aradhe and Justice Tadakamalla Vinod Kumar, clarified that any order of the commission regarding title or property related disputes cannot be sustained under the rule of law. The bench cited the Supreme Court’s observations in the G. Manikyamma vs Roudri Housing Co-operative society case, which made it clear that HRCs are not competent forums for looking into such property issues, as they were beyond its jurisdiction.

The bench was dealing with a petition challenging the status quo orders issued by HRC over Plot No. 23, Villa No. 23, Survey No.s 10/AA and 107/EE at Kokapet village in Gandipet mandal. The HRC had issued the orders on November 22, 2022, when one of the litigants approached it, claiming the property without any evidence.

The other party approached the High Court challenging HRC’s ex-parte orders and its jurisdiction to deal with property related issues.
