Supreme Court strikes down AP land plea

Visakhapatnam: The Supreme Court on Friday upheld the AP High Court order that struck down GO 115 issued by the state government to take back the land given to a Visakhapatnam-based businessman.

The government had earlier allotted 17,135 square meters of land to Katragadda Lalitesh Kumar in Marripalem area of Visakhapatnam. However, the government later issued GO 115 cancelling the allotment.

Lalitesh Kumar filed a petition in the Andhra Pradesh High Court challenging the GO. A single bench of the High Court struck down the GO. On an appeal subsequently, a full bench headed by Chief Justice P.K. Misra endorsed the decision of the single judge.

AP government then filed a petition in the Supreme Court challenging the High Court order.

On Friday a Supreme Court bench comprising judges Dipankar Dutta and Pankaj Mittal upheld the High Court order. The apex court observed that it is not a good decision on part of the AP government to take back a land that it has already allotted to a person.
