Judge insult has Circle Inspector move Chief Justice of India, Kerala High Court
Kochi: The Circle Inspector of Police, Mavelikkara, has sent complaints to the chief justices of the Supreme Court and the Kerala High Court raising serious allegations against a sitting judge of the Kerala High Court. Mr P. Sreekumar, the CI, alleged that the judge had threatened him and showered him with abuses after summoning him to his chamber in the High Court over a case. Justice P. D. Rajan, the judge, summoned him to the court in November 2016 and asked him to remove his relatives from the list of accused in an assault case, he alleged. Mr Sreekumar sent the complaints to the chief justices of the Supreme Court and Kerala High Court on June 6, 2017.
"There was no petition or bail application filed in the case. The judge has no right to harass me on a criminal case not under his consideration. I was brutally ill-treated. I think that justice was denied to a citizen rather than a police officer. I pray that kindly take necessary legal action and make sure that such an act of injustice will not happen to any citizen than a police officer in future," (sic), Mr Sreekumar stated in his complaint. “I have received an acknowledgment for the complaint filed before the High Court. I had filed a complaint before the state police chief in January 2017,” Mr Sreekumar said.
The Mavelikara police had registered a case against Jaison, Chennithala, Bavith Kumar, Thazhakkara, and Sasidharan, Thazhakkara, for attacking a security guard, Damodaran, who attempted to remove them from the Mavelikara district hospital on November 9, 2016. Jaison and Bhavith were arrested in the case. The accused Bhavith Kumar is a habitual offender, the police officer said. The judge contacted the station officer, Mavelikara, and informed that Bhavith Kumar and his father Sasidharan were his relatives and asked him to delete their names from the accused list. According to Mr Sreekumar, the judge scolded him using filthy language and threatened that each police officer who had initiated this case will face consequences.
The police officer was summoned to the High Court through a government pleader. "At the chamber on November 30, the judge asked me my name, education qualification etc. When I said that I am a graduate with B.Ed, the judge rose from his seat and shouted that teachers are always arrogant. The judge abused me with filthy words," the complaint said. The judge also threatened to conduct a Vigilance inquiry against him. “He warned me to stay back in his office until his relatives are cleared,” he said. The cop later consulted the then Ernakulam Range IG who reached the High Court and met the judge. After that, the judge let him go, he said. However, High Court sources refused to make an official comment.
