Perumbavur rape case: Kerala High Court query to IG on ignoring SPCA notice
Kochi: Kerala High Court on Tuesday orally asked why Ernakulam Range IG Mahipal Yadav had ignored the notice issued by the State Police Complaints Authority in the Perumbavur rape and murder case. The court reserved for orders the petition filed by Mr Yadav against the complaints authority order summoning him.
Justice P.B. Suresh Kumar will pass the order in the coming days. Mr Yadav contended that there was no wilful disobedience on his part and that the conduct of the petitioner never invites an offence under Section 166 IPC (public servant disobeying law). The petitioner argued that the SPCA had exceeded its authority in summoning him and the police officers, especially on the basis of a baseless and unfounded complaint and in utter disregard to the apex court orders.
The police have been submitting the progress report of the investigation in sealed covers and the SPCA has no jurisdiction to interfere with the investigation of the crime, he said. The investigation of the crime has already been transferred by the state to ADGP B. Sandhaya and so he had no further role in the investigation of the crime, he said.
