Telangana: Land acquisition Bill to tweak price rule

The earlier Act made all cases against land acquistion filed in courts null and void but the new Act reversed it.

Hyderabad: Three amendments were made to the TS Land Acquisition Act, 2016, that was approved by the Legislature in December 2016 following objections raised by the Centre. The first amendment pertains to date of implementation of the Act and pending land acquistion cases in courts. While the earlier Act mentioned the Act coming into force from January 1, 2014 or from the date the President gives his assent, it was amended stating that the Act comes into force from January 1, 2014, the day when Centre’s Act was enforced. The earlier Act made all cases against land acquistion filed in courts null and void but the new Act reversed it.

The second amendment was made stating that the market price of land will be revised and updated before acquiring lands against earlier provision of considering market value at the time of acquisition. Also the new Act will consider the cases of land owners if they seek fresh compensation in case of abnormal variance between old and new compensation. The third amendment pertains to providing to change in ‘wording’ with regard to relief and rehabilitation package as mentioned in the Centre’s Act against earlier provision of providing ‘better compensation’ than Centre’s Act. Besides the clause “affected parties” include agriculture labourers/ artisans/ small and petty traders, including land owners.
