Delhi HC Slams Police Over Flawed Kapil Mishra Probe

Mishra is accused of promoting enmity and disharmony among religious groups.

Delhi High Court criticizes Delhi Police for flawed investigation against Kapil Mishra, Delhi's new Law Minister. The probe concerns Mishra's 2020 post about the Shaheen Bagh movement against the CAA and NRC. The court noted multiple investigation flaws.

Additional Chief Judicial Magistrate Vaibhav Chaurasia said the court highlighted investigation deficiencies in March and ordered a further probe. Despite repeated orders, the Delhi Police showed negligence.
The court stated, "No one from the investigating agency complied with further investigation directions. Before commenting on their casual attitude, this court must inform the Commissioner of Police, Delhi Police, of the inadequate explanation."
The judge urged police to obtain relevant charge sheet material, as directed over a year ago, and suggested seeking other ministries' assistance if needed. The court set July 7 for the next hearing and asked the Joint Commissioner of Northern Range to act, noting their awareness of the situation.
In 2020, a case was filed against Mishra under Section 125 of the Representation of the People Act for a tweet claiming, "AAP and Congress are creating mini Pakistan like Shaheen Bagh; Hindustan will stand on 8 February, Jab-Jab Deshdrohi Bharat Mein Pakistan Udharenge, Tab-Tab Deshbhakton Ka Hindustan khara hoga." He also made provocative media statements.

In March, the trial court noted significant investigation deficiencies and ordered further probe, stating, "Given the matter's sensitivity, the Deputy Commissioner of Police must monitor the investigation." Additional Public Prosecutor Chiranjeet Singh represented the state. Senior Advocate Pawan Narang, with advocates Neeraj and Himanshu Seth, represented Mishra.
