Hyderabad High Court suspects officials aid builders get injunctions

The bench directed the TSPSC not to declare the results till further orders.

Hyderabad: Sensing that some civic officials were clandestinely facilitating private individuals to obtain injunctions from civil courts to enable them to proceed with construction, the Hyderabad High Court has has directed the GHMC commissioner to produce the list of cases before it by January 3 on which injunctions were granted by the Hyderabad and Ranga Reddy civil courts.

Justice Challa Kodandaram was dealing with a petition challenging a notice issued by the GHMC to a land owner for constructing a house in violation to the sanctioned plan. The judge pointed out that it appeared that civic authorities were facilitating land owners to construct their structures while deviating from the plan.

The judge said, “this court has been noticing that in many of the cases the land owners have obtained injunction orders wherever the GHMC issued notices to them under Section 452 of the Hyderabad Municipal Corporation Act, 1955.”

Justice Kodandaram said it appeared that the authorities were just issuing the notices without pursuing further course of action when the land owners moved the civil courts against the notices.
