Nalapad bail plea rejected yet again

This was the second time Nalapad's bail petition rejected by the same court, the first being on March 14.

BENGALURU: In a setback to Mohammad Nalapad Haris, son of Shanthinagar MLA N.A. Haris, the 62nd Additional City Civil and Sessions Court on Wednesday rejected his bail petition in connection with an assault on 24-year-old Vidwath over a trivial issue on February 17 at the Farzi Cafe in UB City.

This was the second time Nalapad’s bail petition rejected by the same court, the first being on March 14. The High Court too had earlier rejected Nalapad’s bail plea.

Justice Parameshwara Prasanna B. had heard the arguments by special prosecutor M.S. Shyamsundar and defendant lawyer Usman P on Monday and Tuesday and had reserved the order for Wednesday.

While Nalapad’s lawyer submitted that the investigation in the case has been completed and chargesheet has been filed, thus his client can be granted bail, the special prosecutor objected stating the investigation was still underway. He also cited several previous cases where bail was not granted, despite the filing of chsrgesheet by investigating agencies.

Justice Parameshwara who had reserved the order for Wednesday disposed off the petition by rejecting the bail plea. Meanwhile, advocates representing Nalapad have decided to move the High Court and question the order.

Special Prosecutor Shyamsundar told reporters that he had submitted to the court the previous bail rejection orders by the same court and the High Court.

Before rejecting the bail, the court had observed that the case had spread terror in the minds of the people. There are also chances that the accused would threaten the witness and tamper with the evidence if he is released on bail.

Considering all these factors, the court has rejected his bail petition, he said.
