Malicious PILs can't be entertained: Supreme Court

The Bench said the question of issuance of any kind of writ does not arise.

New Delhi: The Supreme Court on Monday made it clear that PILs with malicious intention cannot be entertained and warned the litigants who file such PILs.

A Bench of Justices Dipak Misra and R. Banumathi said the quo warranto writ petition by Anindita and another challenging the appointment of certain persons to a public institution is absolutely the product of disgruntled minds obsessed with their own litigation. They have imagined situations which are beyond realm of any kind of justiciability.

The judges said despite the clear pronouncement by a five-Judge Constitution Bench, the petitioners have, with incurable audacity, made allegations which are absolutely unacceptable and, in fact, can never be conceived of. No litigant can be permitted to browbeat or malign the system. This is essential for maintaining the integrity of the institution and the public confidence in the delivery of justice. It is sheer malice.

The Bench said the question of issuance of any kind of writ does not arise. “The petition, to say the least, is vexatious and, is an expression of pervert proclivity. We would have dismissed the writ petition but we do not intend to do so,” it said.
