Telangana: Land Bill gets Council nod
Hyderabad: The Legislative Council on Thursday approved the controversial land acquisition Bill which was passed in the Assembly on Wednesday. The Bill which brings an amendment to the Central Act, will be sent to the Governor who will forward it to the President for assent.
Article 254 (2) of the Constitution says “Where a law made by the Legislature of a State with respect to one of the matters enumerated in the Concurrent List contains any provision repugnant to the provisions of an earlier law made by Parliament or an existing law with respect to that matter, then, the law so made by the Legislature of such State shall, if it has been reserved for the consideration of the President and has received his assent, prevail in that State.”
Both the High Court and the Supreme Court are empowered to look into the legal validity of the Act, called the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Telangana Amendment) Bill 2016, even after the President assents.
