Madras HC grants bail to DMK’s Senthil Balaji

As per the procedure, the permission should have been given only to the DMK party since they made the application first.

Chennai: The Madras high court has granted anticipatory bail to V.Senthil Balaji, the Karur district secretary (in-charge) of DMK party and DMK candidate for the byelection to the Aravakurichi assembly constituency and Congress candidate S.Jothimani to the Karur Parliamentary constituency and an advocate, who apprehended arrest in connection with a complaint given by the returning officer of Karur Parliamentary constituency, alleging offences under several provisions of IPC including trespassing and criminal intimidation.

Justice R.Subramaniam granted anticipatory bail to Senthil Balaji, advocate N..Senthil Kumar and Congress candidate S.Jyothimani on the condition that they should execute a bond for Rs 50,000 each with two sureties each for a like sum.

They should appear before the inspector of police, Thanthonimalai police station, Karur district on every Monday, Wednesday and Friday at 10 am till June 1, the judge added.

According to petitioners, the DMK party had on April 11 sent an application through online to the returning officer, seeking permission to conduct a public meeting on April 16 between 2 pm and 6 pm. at the bus stand roundana near their party temporary office in Karur district during the Lok Sabha polls campaign. Subsequently, the AIADMK party also sought permission for conducting a public meeting at the same venue between 2 pm. and 5 pm. They gave their application in person. As per the procedure, the permission should have been given only to the DMK party since they made the application first. However, the assistant returning officer granted permission to both parties.
