PD Act against brothel organisers angers Hyderabad HC
Hyderabad: The Hyderabad High Court on Wednesday expressed anger against the Rachakonda police for invoking the Preventive Detention Act against four women who were caught at Yadadri while running brothels. A division bench comprising Justice Raghvendra S. Chauhan and Justice M. Satyanarayana Murthy while hearing cases of the families of the four women said there were other legislations which could be used against the accused. The PD Act was meant for those who indulged in cases of creating a disturbance to law and order. The bench said that the PD Act should be invoked only if the offence has a huge impact on the lives of the public. Running a brothel cannot be compared to goonda activities. Police should keep in mind that no woman would want to enter prostitution, and they resorted to it only if they found it difficult to earn a livelihood.
The bench said that in the name of organising a brothel, the freedom of women cannot be taken away by detaining them under the PD Act. The judges directed counsel for the government to produce the findings of the courts on the conditions to invoke the PD Act and the Acts that were enacted to control prostitution by Thursday.
