Hyderabad High Court relief for Filmnagar Cultural Centre
Hyderabad: The Hyderabad High Court on Friday directed the GHMC to remove the seal and allow full-fledged activities in the Filmnagar Cultural Centre at Jubilee Hills in Hyderabad.
Justice Challa Kodandaram, while dealing with a petition by the Filmnagar Cultural Centre seeking to declare the GHMC’s seizing of the club premises on July 24, 2016 as illegal, granted the interim order.
Counsel for the GHMC told the court that the building was sealed following the death of two workers due to collapse of an under-construction portion of the portico.
He said that the GHMC authorities noticed that the club management was carrying out the construction without permissions from the corporation.
Counsel for the petitioner contended that Section 461 (A) of the GHMC Act mandates the authorities to issue a notice before sealing any premises and the GHMC commissioner has to pass an order sealing the premises only after receiving a response to the notice.
He said that in this case, the GHMC neither issued a notice nor passed any order but sealed the premises, which was illegal.
While noting that the civic authorities failed in following the procedure in sealing the premises, the judge granted the interim order.
