Wrap-up: Islam allows 4 wives sans talaq, says SC
The Supreme Court on Friday observed that if Islam allows four wives then the husband can marry for the second time even without talaq.
Making this oral observation, Chief Justice T.S. Thakur heading a three-judge bench, indicated that prima facie there is nothing wrong in a Muslim man having four wives without divorcing the first wife.
The bench said, “Unless and until the constitutionality of ‘triple talaq’, permitted under the Muslim personal law, is struck down by court, the Muslim Personal Law allowing a man divorce his wife by pronouncing the phrase thrice is valid.”
No Ram Rajya
Observing that court cannot find a solution to all the ills in the country, the SC said it does not have a magic wand to create a Ram Rajya.
Chief Justice T.S. Thakur dealing with a PIL filed by NGO Voice of India seeking a blanket order directing authorities all over the country to remove encroachments from footpaths, said: “We cannot order that all corruption in India should be stopped. We cannot bring about a Ram Rajya.”
