Chennai: Madras high court has appointed Justice K. P. Sivasubramanian, a retired judge of the Madras high court, as the judge-commissioner to hold the extraordinary general body meeting (EGM) of the Andhra Social and Cultural Association, known as Andhra Club, in T Nagar.
Justice N. Sathish Kumar, when a batch of civil suits and applications from S. Seshadri and three others, came up for hearing has appointed Justice K. P. Sivasubramanian.
The petitioners had leveled various allegations including induction of new members, against the office-bearers of the association. On hearing submissions of advocate S. Thankasivan and others, Justice N. Sathish Kumar said that all is not well and not acted according to the law. “Therefore, I am of the view that admittedly 89 members were made as members as the son or son-in-law of the existing members. But, in fact, they are neither son nor son-in-law of the members.”
The judge said therefore, when such people become members in utter violation of by-laws, they cannot have any say in this suit until a proper extraordinary general body meeting is conducted in a proper manner to take a decision as to whether or not to regularise those members. The right of the members, who are inducted under the children's quota will also be decided only by the EGM, subject to the majority view of the meeting.
After appointing Justice K. P. Sivasubramanian as the judge-commissioner the Justice N. Sathish Kumar has observed that “in view of all these facts, this court is of the view that unless a fresh EGM is called to decide the right of the above persons, the members, who have come through back-doors cannot have any say. Their right has to be decided in the EGM.”
Disposing of the civil suits and the application, Justice N. Sathish Kumar said the judge-commissioner shall call for the EGM within three months and decide the action to be taken against the members who are involved in inducting third parties as members under the children's quota by secret ballot system. Immediately thereafter, he shall also hold election to the club strictly as per the by-law for 2017-19.
