Karnataka high court vacates stay on teachers' transfer

Rural teachers can be transferred to towns.

Bengaluru: The Karnataka High Court on Monday vacated an interim order of stay earlier granted by it on a notification with regard to the transfer policy of teachers introduced by the state government.

The court was hearing the interlocutory application filed by the state government seeking vacating of stay granted by the court on May 8, 2018 with regard to a petition filed by Prabha Adigal. The state government contended that the petitioner had challenged the notifications dated January 1, 2018 and January 6, 2018 issued by the Director of Primary Education and Director of Secondary Education respectively.

According to teacher's transfer policy published by the government, teachers who are serving for more than 10 years in BBMP and metropolitan regions will be compulsorily transferred to rural areas. Those who have completed 10 years of service in municipality towns will be transferred to metropolitan cities. Rural teachers can be transferred to towns.

The state government further in its application stated that the notifications are only the transfer guidelines issued by the Department for regulating the modalities of transfer of teachers of primary and high schools across various zones and have been issued in consonance with the the Karnataka Civil Service (Regulation for Transfer of Teachers) Act 2007 and the Karnataka Civil Service (Regulation for Transfer of Teachers ) Rules 2017.

Ravi Belagere case
The high court has rejected the state government’s plea seeking to cancel the bail granted to Hai Bangalore editor Ravi Belagere in connection with a case where he is accused of conspiring to murder former colleague Sunil Heggaravalli.

The prosecution had filed the petition on various grounds including that the lower court has failed to consider the nature of the accusation and that the accused has no regard for law and severity of punishment in case of conviction.

The HC has rejected the state's plea on the ground that chargesheet has been filed in the matter and that there are no violation of bail conditions.
