Madras High Court special bench to hear medical admission appeals

A maximum of 10 marks for experience was provided to all candidates.

Chennai: Chief Justice of the Madras High Court on Friday agreed to constitute a Special Bench to hear the appeals relating to Post Graduate Medical admission during vacation, which will start from May 1. Pursuant to the order passed by a division bench on April 27, granting liberty to the parties to request the Chief Justice to constitute a Special Bench for hearing the matter during vacation, senior counsel P.Wilson and KM Vijayan, appearing for the candidates and Special government pleader TN Rajagopalan made a mention before Chief Justice Indira Banerjee on Friday to constitute a Special Bench to hear the appeals during the vacation considering the urgency involved in the matter and the seats have to be filled up before May end. Acceding to their request, Chief Justice agreed to constitute a Special Bench to hear the appeals.

Originally, on a petition from Dr Rajesh Wilson, Justice Pushpa Sathyanarayana had on April 17 directed the state government to add incentive marks as per the percentage prescribed in MCI regulations for in-service candidates, on the marks secured by them in the NEET examination while preparing the rank list for admission to the PG courses in the 50 percent reserved category for government servants. Aggrieved, Dr Prabhu and 11 others filed the present appeals.

As per the proviso to Regulation 9 (4) of the Post Graduate Medical Education Regulations framed by the MCI, a maximum of 30 percent of marks obtained in NEET will be added as an incentive to those in-service candidates in remote and/or difficult areas. However, in the prospectus issued by the Directorate of Medical Education for the year 2017-18, a maximum of 10 marks for experience was provided to all candidates.
