Hyderabad High Court to hear plea on CLP merger on January 3
Hyderabad: The Hyderabad High Court has postponed to on January 3, 2019, the hearing a plea filed by Congress MLC Shabbir Ali, requesting directions to suspend the bulletin issued for merging the members of Congress Legislature Party in the Legislative Council of the state with TRS Legislative Party.
A division bench comprising Chief Justice Thottathil B. Radhakri-shnan and Justice S.V. Bhatt, while hearing the petition on Thursday, said that it would hear the matter during the first week of January 2019. Mr Shabbir’s counsel asked the plea was urgent, as the Constitutional values were being disrespected by the chairman of the Legislative Council by merging the CLP Congress with the TRSLP.
The bench commented that merging of the parties comes under the civil case, but as the case is a merger of legislative members, so it would hear the plea of the petitioner.
Mr Shabbir in his petition alleged that the chairman of the Legislative Council has exceeded his Constitutional powers in treating the members of the Congress in the Council, Akula Lalitha, T. Santosh Kumar, M.S. Prabhakar Rao and Kuchukulla Damodar Reddy as the Members of the TRSLP and allocating them seats in the House accordingly.
He also submitted that the court can interfere under limited judicial review into the decision of the chairman on merging the Congress, a recognised national political party, with the TRS without a reference to a petition under Schedule 10 of the Constitution.
