Hyderabad: The Hyderabad District Consumer Disputes Redressal Forum-2 recently ordered Narne Estates, a real estate company, to pay a compensation of Rs 1 lakh and Rs 5,000 as costs to a plot buyer apart from returning Rs 2.68 lakh with nine per cent interest for not developing the layout.
Mr Amar Singh Chouraria, a resident of Karkhana in Secunderabad, who filed the complaint against Narne Estates had booked four plots of 250 square yards each. He joined as a member in 1996 after an initial payment of Rs 20,000.
Mr Chouraria paid instalments till 2004 totaling Rs 2.68 lakh. When he visited the plots to see the progress of the development, he found no activity. He sent a notice to Narne Estates seeking a refund of the amount paid along with interest.
Narne Estates could not deliver the plots allotted to the complainant in East City Extension as it had led to litigation with some other party. Instead, Narne offered two 500 sq.yd plots in another area but without the consent of the complainant. It was rejected by the complainant in 2011 who asked for return of the money.
Narne Estates in its reply said it had demanded that Mr Chouraria pay developmental charges and cited delay in the payment of plot cost. Instead of paying developmental charges, Mr Chouraria demanded return of the amount along with 18 per cent interest, it said.
The forum found that the complainant had suffered mentally and physically and was entitled to compensation for his mental agony.
Travel agent fined for goof
The Kadapa district consumer forum has ordered a representative of the travel firm Cox and Kings to pay Rs 2 lakh as compensation to a complainant who could not go on a Russia tour and pay Rs 25,000 towards mental agony and Rs 10,000 as costs.
Mr S. Ramaiah Che-tty, a resident of Proddatur in Kadapa district. and his wife Ganga Maheswari alleged that due to the negligence of Mr K.Subramanyam, a sales officer with Cox and Kings at Tirupati, he was stuck in Finland and returned to India without visiting Russia as his visa was rejected.
The complainants had chosen the 15-night and 16-day tour titled ‘Scandinavian Delight with Russia’ and paid Rs 3.42 lakh on March 20, 2014. The tour started on May 19. They were informed that visas for Russia would be handed over in Finland. At Finland, the complainants did not get the visa and were held up due to the negligence of the sales officer of Cox and Kings. From Finland, they returned to Hyderabad as no help reached them.
