HC refuses to hear anticipatory bail petition of Avinash Reddy

Court's summer vacations begin on Monday

HYDERABAD: In a major setback to Kadapa MP Y.S. Avinash Reddy, two separate single benches of the Telangana High Court were on Friday not inclined to hear his anticipatory bail petition and give partial relief from being arrested by the CBI in the Y.S. Vivekananda Reddy murder case.

The two benches also rejected Reddy’s plea to direct the registry of the High Court to post the matter before the vacation bench: The High Court’s summer vacation starts on May 1.

When his counsel requested the court at 4 pm to hear the case, as no regular court would be working from Monday, Chief Justice Ujjal Bhuyan shot back, “Do you think that this court does not have any other matters to hear, other than your case.”

The Chief Justice also cautioned advocates against pressuri2ing courts to hear their cases either urgently or on a particular day and time. He told counsel that the court will not direct the registry to post the matter before the vacation bench.
Earlier, Justice K. Surender, who has been hearing the Reddy’s anticipatory bail petition, observed at 3.30 pm that due to paucity of time he would not be able to pass orders. He posted the case for June 5, when the court is scheduled to reopen.

Objecting to it, Avinash Reddy’s counsel sought interim protection from arrest till the time of hearing. The judge said the matter was posted before him on the directions of the Chief Justice and wondered how he could redirect it to another judge. The judge pointed out that the Supreme Court itself has not granted any relief for protection from arrest and said he was not inclined to grant any relief.
