Telangana: Plea on BC panel chief's appointment
Hyderabad: The Hyderabad High Court on Monday sought to know the stand of the TS government on a petition challenging the amending of the Telangana Commission for Backward Classes (Amendment) Act, 2016 to constitute the Telangana Backward Classes Commission and appointment of B.S. Ramulu as its chairman.
A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice Shameem Akhter was hearing the petition by S. Lakshmi Narayana and three others.
A. Satya Prasad, senior counsel appearing for the petitioners, submitted that the TS government adopted the AP Backward Commission Act and brought in certain amendments to constitute the commission and to appoint the chairman from social activists or persons working for the cause of the Backward Classes.
He contended that the state government’s action was in contradiction of Article 14 of the Constitution and also contrary to the judgement of the Supreme Court in the case of Indra Sawhney vs. Union of India.
The objective of the Supreme Court order is that appointment of a chairman to the commission shall not corrupted by political influence, Mr Prasad said.
Reminding that earlier, the commission was headed by retired judges, he argued that the person heading the panel has to be well versed with law.
While issuing notices to the state government, BC Commission chairman, Law Secretary, Secretary to BC Welfare and other, the bench adjourned the case.
