Hyderabad High Court pulls up Medak cops

Police told to lift curbs imposed on public.

Hyderabad: Maintaining that the movements of citizens cannot be curbed the Hyderabad HC on Monday ordered the Medak district police to strictly adhere to the letter and spirit of the order passed by the Executive Magistrate imposing Section 144 of Cr.PC on July 28, 2016 in Vemulaghat village.

Granting the order on a petition by Y. Santosh Reddy and others seeking to vacate the ban orders, Justice M.S. Ramachandra Rao directed the police not to interfere with the rights of villagers or outsiders to move freely in the village.

Observing that the village is not a disturbed area, the judge ordered the police not to insist on people to prove their identity or ask them to reveal their movements. The judge directed the police not to prohibit people from entering the village if they do not carry weapons.

Takeover of land stayed
The Hyderabad HC on Monday stayed land acquisition for the Kalyani Khani Open Cast Mining project in Adilabad district.
Justice Suresh Kumar Kait issued the order while dealing with a petition by K. Achuta Rao and four others seeking to declare the land acquisition for the mining project with dubious environmental clearance and without any rehabilitation scheme as illegal.

Ms. B. Rachana, the counsel appearing for the petitioners, contended that no project can be undertaken without prior approval of the gram sabhas of the villages affected. She said the forest access rights of the villagers must be protected as per the Panchayats (Extension to Scheduled Areas) Act, 1996, (PESA) and other laws. The counsel told the court that the government had issued the notification on June 23, 2016 for land acquisition in the Kasipet village and have been threatening to evict tribals and forcibly demanding their signatures to take over their lands. The judge issued notices to the respondents.

Court to hear CBI
The Hyderabad HC on Monday made it clear that it cannot grant any order in Nayeemuddin’s case without hearing the CBI. CPI leader Dr K. Narayana, who had filed a PIL seeking a CBI probe into the criminal activities of Nayeem, appeared before the court on Monday and urged it to take up the case urgently.
A division bench said it will take up the case when it reaches the court. The petitioner brought to the notice of the court that there were allegations of police and politicians having links with Nayeem.

HCA to obey Lodha panel
The Hyderabad Cricket Association on Monday informed the HC that it would abide by the recommendations of the Lodha Committee to amend its bye-laws and hold elections.
Justice M.S. Ramachandra Rao was dealing with two petitions filed separately by the St Mary’s Cricket Club and another questioning the amended bye-laws of HCA which provides for election of the managing committee only in September 2017. The petitioners told the court that the Lodha commission indicated that by September 30, 2016 the bye-laws of the HCA had to be amended and by October 2016 elections held.
The judge ordered that all new decisions of the HCA will be subject to the recommendation of the Lodha Committee.

TS plea on eggs upheld
The HC upheld the condition set by the TS government that tenders for the supply of eggs to Anganwadi Centres will be accepted only from poultries which are having registration with the National Egg Coordina-tion Committee. A division bench allowed an appeal by the government on this.
Challenging the order of a single judge staying the notification issued by the Integrated Child Development Project director of Mahbubnagar district inviting tenders for the supply of eggs to 20 Anganwadi centres in the district from poultries which have registration with the NECC.
While staying the notification the judge directed the authorities to issue a fresh notification without the condition of having registration with NECC
The government told the bench that with a view to supply quality eggs to children it had set the condition that eggs will be procured only from poultries registered with the NECC.
