Implement land use law, says Kerala High Court

The order also mandates amendment to the panchayat, municipality building rules for the purpose

Kochi: The Kerala High Court on Monday asked the state government to implement in two months the amendment to the building rules which stipulates that building permit be granted only if the certificate given by the village officer (making it clear for which purpose the land deed was granted) is produced.

The interim order was issued on a petition filed by West Wine Resort Limited for denying occupancy certificate alleging that a resort built at Vengappalli panchayat in Wayanad in line with the building permit had violated land rules.

The single bench which considered the petition had earlier said that for giving sanction for constructing the building, various departments should come together to set up a single window for clearances. Following this, the government submitted before the court the order issued by the revenue department on August 22 making the certificate issued by the village officer mandatory for building permit in Idukki district.

The RD order mandates that the LSG department should issue orders within two weeks making it clear that building permit should not be granted without the certificate of the village officer. The order also mandates amendment to the panchayat, municipality building rules for the purpose. After verifying this order, the court impleaded the industries and tourism secretaries in the case to ensure the co-ordination between various departments for sanctioning building permits. The court also asked the government to amend the building rules so as to make it applicable across the state.
