Include elected members in AP Wakf board: Hyderabad High Court
Hyderabad: The Hyderabad High Court on Monday permitted the AP government and the AP Wakf Board to include elected members under the MLA/MLC quota into the governing body of the Wakf Board.
A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice K. Vijaya Lakshmi, while dealing with an appeal by the AP Wakf Board, suspended an order of a single judge who had ordered for the constitution of the governing body without members from the MLA/MLC quota.
Mustafa Shaik a resident of Guntur earlier moved a writ petition challenging the notification issued in August 2017 to conduct the elections to the Wakf Board contending that the notification was in contrary to the Wakf Act.
He submitted that as per the Act elections have to be held for two members each from the MLA/MLC category and the mutawalli category, but the rules had changed by the state government reducing the number from two to one so that only one Muslim MLA in the ruling party got elected.
Earlier, a single judge stayed the election and when the Wakf Board moved an application to vacate the stay which another single judge had granted order for constituting the governing body without members from the MLA/MLC quota.
Aggrieved by the order, the Wakf Board moved the appeal and the bench, while dealing the case, let the elected members be included and the issue of the number of members to be elected from legislature quota can be decided later.
