Hyderabad: PIL against buildings plan at Bhojagutta rejected

The petitioners urged the court to direct the GHMC to revoke the permission and remove the encroachments.

Hyderabad: The Hyderabad High Court on Tuesday refused to entertain a PIL questioning the action of the Greater Hyderabad Municipal Corporation (GHMC) in granting permission to the Telangana State Housing Board to construct houses at Bhojagutta area of Asifnagar.

A resident of the city Syed Mohammed Fayaz along with another petitioner moved the PIL stating that the GHMC has granted permission to M/s NJR Constructions and Builders to construct houses on behalf of the Board in 13 acres at Bhojagutta and that the construction company has even taken more land than the permitted area by encroaching upon an adjacent land belonging to a dargah and a mosque.

The petitioners urged the court to direct the GHMC to revoke the permission and remove the encroachments.

A division bench noted that a writ petition was pending before a single judge with regard to the same issue and entertaining the PIL would lead to contradictory orders in the case.

While stating that it would not be proper to file the PIL when a writ was already pending in the court on the same issue, the bench made it clear that it will not intervene in the matter.
