Grant of government land to private parties violates law and amounts to encroachment.

Bengaluru: The claimants of the now disputed land in (erstwhile Survey 29) of Ramanayakanahalli Anekal taluk, among whom is Chief Secretary Arvind Jadhav's mother Tarabhai Marutirao Jadhav, may have to lose claims on the land after Revenue officials woke up to the fact that the grant of the said government land to private parties reportedly violates the Karnataka Land Revenue (KLR) Act of 1964 and could hence amount to encroachment, official sources told this newspaper.

"Under Rule 10 of the Karnataka Land Grant (KLG) Rules the special deputy commissioner (DC) in special cases can authorize grant of government land to private persons after a cooling period of 15 years provided the land did not fall within 16 km of Bengaluru City limits.

Section 94 of the KLR Act makes it compulsory to evict an encroacher and Section 94A of the Act clearly prohibits regularization of the land, which falls within 18 kilometres of border of Bengaluru City limits. This disputed land reportedly falls within two to three kilometers of City limits hence regularization is illegal and contrary to Section 94 of the KLR Act," said an official source.

He added that the law is clear on grant of government land. "The Special DC can in special cases authorize grant of land, where a poor or eligible family seeks a land grant provided the land that the government chooses to grant is not within 16 km of Bengaluru City border (Rule 10 of KLG Rules).

Section 94 makes it compulsory to evict an encroacher and law does not permit regularization at all," he added. The Chief Secretary had on Tuesday clarified that there was no rregularity in the purchase of land by his mother.
