Way for unauthorised structures predating July 2007

Building owners and building promoters should file an application online for regularisation to the competent authority within six months from now.

Chennai: The State has amended the Town and Country Planning Act of 1971 to regularise or grant amnesty to unauthorised buildings built before July 1, 2007.

The government has introduced Section 113-C to the Town and Country Planning Act, 1971 to exempt unauthorised buildings developed on or before July 1, 2007 from the provisions of development regulations framed under the act. It means that unauthorised buildings that had existed before the said date in Chennai Metropolitan Area and areas covered under the control of Directorate of Town and Country Planning across the State cannot be demolished.

However, according to the press release from the secretariat, the amendment cannot be applied to those buildings with any encroachment including aerial, public road or street or any government or local authority owned lands, water bodies, open spaces reserved as parks and playgrounds in master plan or detailed development plan or new town development plan or approved layouts.

Individual building owners and building promoters who have put up unauthorised constructions before the said date of July 1, 2007 should file an application online for regularisation to the competent authority within six months from now, added the release.
