Tamil Nadu: PIL seeks 4 per cent quota for disabled in teachers posts
Chennai: A Public Interest Litigation has been filed in the Madras high court to direct the authorities to provide 4 percent reservation for persons with disabilities in the direct recruitment to the post of Post Graduate Assistant/Physical Education Directors Grade-I in school education and other departments for the year 2016-17.
A division bench comprising Justices M.M.Sundresh and R.Mahadevan before whom the PIL filed by Tamil Nadu Association for the Rights of All Types of Differently Abled and caregivers represented by its state secretary S.Nambirajan, came up for hearing ordered notice to the state government and Teachers Recruitment Board and posted to June 2, further hearing of the case.
Petitioner sought to quash a notification issued by the TRB for the direct recruitment of Post Graduate Assistant/Physical Education Directors in School Education and other departments for the year 2016-17 and consequently direct them to issue a fresh notification by providing 4 percent reservation and forming new roster to that effect and also to remove the restriction imposed upon the persons with disabilities under certain category.
According to petitioner, section 34 of the Rights of Persons with Disabilities Act, 2016 provides for reservation of 4 percent to the persons with disabilities but the notification provides only 3 percent reservation, which was against the Act.
Clause 3 (b) (iii) of the notification imposes restriction in such a way that the persons with disabilities within the category of OA (one arm), OL (one leg) and BL (both legs) suffering with 40-70 percent were alone eligible to apply, which was against a G.O issued by Welfare of Differently Abled Persons department as the said G.O does not impose any restriction to the post of Post Graduate teachers.
