Madras high court: Give report on projects in Global Investors Meet

A division bench comprising Justices M.Sathyanarayanan and P.Rajamanickam dismissed the petitions filed by Cascade Energy Pvt.Ltd.

Chennai: Noting that the state government is spending considerable amount in making the Global Investors Meet, 2019, a grand success and the said effort should necessarily be transformed into good and properinvestments, so as todevelop industrialization and generate employment especially for the local people for their well being, the Madras high court has directed the state government to file a status report as to how many projects came into being on account of the Tamil Nadu Global Investors Meet, 2015, present stage of such projects, as well the MOUs reached and the agreements signed in pursuant to the present Global Investor Meet, 2019 and generation of employment.

A division bench comprising Justices M.Sathyanarayanan and P.Rajamanickam dismissed the petitions filed by Cascade Energy Pvt.Ltd, a Singapore based company which sought a direction to the state government to frame guidelines in order to protect the foreign investors from getting cheated by the tainted companies in the interest of the nation.

The bench said initially, the concept of Public Interest Litigation came into being as poor and down trodden were not aware of the legal rights, rules and lacks necessary resources to approach the court and involve themselves in costly litigations and of late, it became a tool for misuse, as pointed out by the Supreme Court.

The averments made in the affidavits filed in support of the writ petitions were mainly targeted against the newly impleaded private respondent /Zynergy Solar Products and Services Pvt.Ltd and either tenable or legal grounds have been raised by the petitioner seeking positive directions in the form of prayer sought for by them in these petitions, the bench added.

The bench said, “In the considered opinion of the court, a perusal of the materials placed in the form of typed set of documents as well as the submission made by the Advocate general would disclose that proper mechanism has been put in place, but at the same time, it is to be noted that the state government is also spending considerable amount in making the Global Investors Meet, 2019 a grand success and the said effect should necessarily be transformed into good and proper investments, so as to develop industriazation and generate employment especially for the local people for their well being. Hence, it is necessary on the part of Additional Chief Secretary, Industries Department to file a status report”, the bench added and posted to June 10, 2019 for filing status report.
