Kodela: Pil for CBI probe dismissed

Rejecting his pleas, the court reposed confidence in the efficiency and ability of the Telangana Police in dealing with this case.

Hyderabad: The Telangana High Court on Tuesday dismissed a Public Interest Litigation (PIL) seeking a CBI probe into the death of former speaker of Andhra Pradesh assembly Dr Kodela Sivaprasada Rao, who hung himself in his house earlier this month.

A division bench comprising Chief Justice Raghavendra Singh Chauhan and Justice A. Abhishek Reddy, while hearing the PIL filed by Anil Kumar Borrugadda, asked his counsel, how the petitioner was related to the issue and in what way was it a public interest litigation.

Chief Justice Singh observed that in any situation, when a person dies, only persons aggrieved will be either family members or close relatives of deceased, who can raise objections. In this case, the petitioner was neither here nor there, so how could the court entertain such persons, he asked.

Recalling the Supreme Court observations on non-interference into investigations in any manner, the HC bench said that the Apex Court has, time and again, made observations directing courts not to interfere into cases where investigation was already under process.

The court said that in India everybody raises voice against ongoing investigations, but in a country like Sweden, once an FIR is registered, even the media was not allowed to report on the investigations.

The counsel for the petitioner told the Bench that the Telangana police, which had taken up investigations in the matter, was “not moving ahead in a proper manner”, and asked the court to direct the police to file a report.

Rejecting his pleas, the court reposed confidence in the efficiency and ability of the Telangana Police in dealing with this case.
