Dismiss TTV Dinakaran loyalist's appeal, Tamil Nadu CM urges Madras HC
Chennai: Chief Minister Edappadi K. Palaniswami has informed the Madras high court that the suit and appeal filed by P. Vetrivel, an MLA and a loyalist of TTV Dinakaran against AIADMK general council meeting held on September 12, are not maintainable and hence may be dismissed with exemplary cost.
A division bench comprising Justices Rajiv Shakdher and N. Sathish Kumar, before whom the counter affidavit was filed, directed all other respondents including E. Madhusudhanan, O. Paneerselvam to file their counter affidavits within two weeks and rejoinder if any, be filed by a week thereafter.
The bench posted to November 30, further hearing of the case.
Originally, Vetrivel filed a suit and another application to restrain the defendents (Palaniswami, Paneerselvam and others) from using the name of AIADMK or AIADMK (Amma, Puratchi Thalavi Amma) for calling a general body meeting. Justice C.V.Karthikeyan dismissed the application and imposed a cost of '1 lakh.
Aggrieved, on the same day, Vetrivel filed an appeal and the current bench had declined to stay the order of the single judge but said any decision taken at the general council meeting will be subject to the final outcome of the appeal.
In his counter, stated that the two groups that were existing in AIADMK party have already united.
This was being objected to by TTV Dinakaran and the plaintiff (Vetrivel) was only a supporter of Dinakaran. Therefore, he wants to project Dinakaran as the leader of the Amma group of AIADMK, when in fact, he has been the leader of the said group even before the two groups united, he added.
