Telangana HC orders child's custody to mother

The father was directed to hand over custody of the child to his wife within a week

HYDERABAD: A two-judge bench of the Telangana High Court allowed a mother to have custody of her seven-year-old daughter. The bench, comprising Justice K. Lakshman and Justice K. Sujana, disposed of the case by directing the respondent, the father of the child, to hand over custody to his wife, the petitioner, within a week. The petition was filed by the mother on the grounds that their daughter was illegally taken away by the father. Counsel for the petitioner said that the husband forcibly sent the wife out of the house. She submitted that at a meeting of elders, which was held at the instance of the petitioner’s father, the husband refused to hand over custody. The husband blocked the contact number of the petitioner, changed his residential address and absconded along with their daughter. The petitioner registered a case of domestic violence against her husband and his family members at the Malkajgiri police station. She approached Lalaguda police station to trace the whereabouts of the missing girl but in vain. The petitioner stated that the girl needed the affection of the mother. While granting custody to the mother, the court granted liberty to the father to approach a competent court for visitation rights.

Gulf Oil writ petition dismissed:

Justice C. Sumalata of the Telangana High Court refused to entertain a writ petition by Gulf Oil Corporation against Udasin Mutt on 540 acres of land at Kukatpally. The endowments tribunal ordered the eviction of the petitioner (initially Indian Detonators Ltd) in September 2011. The order was upheld by both the High Court and the Supreme Court. On the question of mesne profits to be paid for overstaying in the land, the petitioners filed the present petition. They contended that the period spent in the litigation should be excluded while calculating the mesne profits, which the judge rejected.

Plea challenging VRA appointment dismissed:

Justice P. Madhavi Devi of the Telangana High Court dismissed a writ plea seeking appointment as village servant/assistant of Peddamupparam gram panchayat in Mahabubabad district. The judge was hearing a writ plea filed by J. Ramulu and five others, working in the Armoor municipality, challenging the current appointment. The judge stated that the post of VRA was not hereditary. The respondents considered the case of the dependents and thought it fit to appoint his elder son as a village servant and that was never challenged by the brothers. The judge also observed that after the death of the deceased, the respondents had considered the case of his daughter Koma Yama for appointment as a village servant in November 2020 on compassionate grounds. The judge opined that the court does not find any illegality in the appointment of the daughter of the deceased made especially on compassionate grounds.
