Tamilisai now seeks to withdraw plea against Kanimozhi

Chennai: The defeated candidate of BJP Tamilisai Soundararajan, now the Governor of the State of Telangana has filed a petition in the Madras high court to permit her to withdraw her election petition, challenging the election of DMK MP Kanimozhi from the Thoothukudi Parliamentary Constituency during the election held on April 18, 2019.

When the election petition filed by Tamilisai Soundararajan came up for hearing before Justice S.M.Subramaniam, K.Ramanamoorthy, counsel for the petitioner filed the present petition.

Directing the counsel for the petitioner to complete the procedure for withdrawing the election petition and report before the court, the judge posted to October 14, further hearing of the case.

In her petition, Tamilisai Soundararajan submitted that she has filed the election petition challenging the election of Kanimozhi from the Thoothukudi Parliamentary Constituency. This court was pleased to admit the petition on September 5 and ordered notice to Kanimozhi, Election Commission of India and the Returning Officer, Thoothukudi Constituency. However, in the interregnum, she was appointed as the Governor of the State of Telangana by the President of India. In view of the fact that she has been appointed to a constitutional post, she did not intend to continue to prosecute the election petition filed by her before this court. Consequently, she seeks permission of this court to withdraw the election petition filed against Kanimozhi before this court. “The present application filed by her for withdrawal of election petition is not induced by any bargain or consideration”, she added.
