MLA disqualification case: Final hearing on August 31
Chennai: The Madras High court has adjourned the case relating disqualification of 18 MLAs to August 31 for final hearing.
The Supreme court appointed third judge to decide case Justice M Sathyanarayanan has adjourned the matter after senior counsel Ariyama Sundaram, appearing on behalf of Speaker, sought for an additional an hour to complete his argument.
Earlier, Senior counsel PS Raman dismissed the allegation that unless the 18 rebel MLAs of AIADMK were disqualified they would have voted against the government and toppled it. The senior counsel said that the ruling party would have won the floor test as they still were up by three or four MLAs. He said the MLAs never asked for floor test but they only sought for change in chief minister. But, only the DMK in a representation asked for a floor test.
Ariyama Sundaram submitted that issue is not about what the governor could do in such circumstances, but what the MLAs wanted the governor to do. They wanted him to involve the constitution process, that is the question.
He said the petitioners cannot use the chief minister to elicit their case. Whether they approached the chief minister or not is the question. The MLAs also informed that they were unwilling to participate in the legislature party meeting to which they were invited.
