Chennai: SHRC tells cop to pay Rs 1 lakh to vendor
Chennai: The State Human Rights Commission has directed a retired SI of Kancheepuram district to pay a compensation of Rs 1 lakh to a sweet stall vendor for detaining him at prison on after registering a false case.
In the petition, V. Manoharan of Mettu Street, Kancheepuram, a sweet shop owner, submitted that in 1999 he entered into a lease deed with N.K.S. Balasubramanian, who owned a vacant plot measuring 1760 sq.ft. in the same place. He paid him an advance of Rs 15,000. Later, Manoharan constructed building and regularly paid monthly rent to Balasubramanian.
Meanwhile, Balasubramanian attempted to sell the property and insisted that Manoharan vacate the place. On December 7, 2007 at about 10.30 am,
Ekambaram and his wife Pushparani along with few henchmen informed him that they purchased the property and they also ordered him to vacate.
On December 8, 2007 at about 7.00 p.m, V. Mariappan, SI, Vishnu Kanchi Police Station, along with Ekambaram and some henchmen entered into his shop, assaulted him. The cop also registered a false complaint against Manoharan, his wife and his brother-in-law. He was arrested and remanded to judicial custody. He threatened his wife.
Next day, about 10.30 p.m, the SI and Ekambaram and Pushparani assaulted his father, mother-in-law and another person. After chasing them, they demolished the kitchen and locked the house. The policeman threatened to file another false against Manoharan if he opens the shop again.
In his reply, V. Mariappan denied the allegations and said it was a false complaint. Member Dr A. Chittaranjan Mohandoss, said the policeman had unnecessarily laid his hands on Manohar-an only with the intention of evicting him from the property, which is under dispute. The Commission directed the SI, now retired, to pay a compensation of Rs 1 lakh to Manoharan.
