Constitutional Bench to study Speaker's powers

A few months ago, a three-member Supreme Court bench had held that the matter be entrusted to a Constitutional Bench.

Hyderabad: Chief Justice of India Dipak Misra on Friday announced that a Constitutional Bench would be set up to decide on the nature of the powers held by Speakers of Legislative Assemblies in dealing with petitions seeking disqualification of its members who have defected to other parties.

The subject comes under the 10th Schedule of the Constitution. Justice Misra assured petitioner S.A. Sampat Kumar, Congress MLA from Alampur, that the bench would be constituted after the Dasara vacation.

On Friday, Mr Sampat Kumar, appeared before the Chief Justice’s court to seek the constitution of the larger bench.

As per the provisions of the 10th Schedule, the Speaker or any other presiding officer of legislative bodies decides on matters such as disqualification of members on the grounds of defection.

There is no time limit.
His petition deals with the defection of seven Congress legislators to the ruling TRS, without resigning their Assembly seats, and the Speaker not holding hearing in the matter or ruling on it for two years.

HC clears path for TET results
The High Court paved the way for declaration of Telangana State Teachers Eligibility Test by vacating the stay granted earlier.

Justice S.V. Bhatt was dealing with a vacate stay petition by member secretary of the TS TET. The stay had been granted on the petition of one Dattatri of Adilabad challenging the action of the authorities in changing the guidelines after conducting the examination.

The judge said for the sake of one petitioner hundreds of aspirants cannot be made to suffer.

Judge gets fond farewell
The Bar and Bench of the Hyderabad High Court bid farewell to senior judge Justice Raja Elango on his retirement. Besides Acting Chief Justice Ramesh Ranganathan , all judges and the advocates assembled in the First Court Hall for the farewell and recalled the services of Justice Elango. Members of the advocates' associations felicitated the judge in the association hall.
