Drivers to face penalty for violating Motor Vehicles Act

The minimum negative point is one and maximum five for an offence depending upon the violation.

Hyderabad: The Telangana state government on Thursday issued preliminary notification for giving negative points to motorists violating various provisions of the Motor Vehicles Act. The minimum negative point is one and maximum five for an offence depending upon the violation.

The driving licence will be suspended for a year if the motorist accrues 12 points within 24 months. Fifteen days’ time has been given to people to submit objections and suggestions on the penalty points system to the transport department principal secretary after which the negative points system will be implemented following a final notification anno-uncing its date, according to a GO issued by transport department principal secretary Sunil Sharma.

If a person, whose licence has been suspended and later revoked after completion of the one-year period under Rule 45-A(4)(i), again accrues 12 points, that driving licence shall be suspended for a period of tw years from the date of accrual of the said 12 points. On further accumulation of 12 points every time, the driving licence shall be suspended for a period of 3 years.

If a person holding a learner's licence accrues five points during the validity period of learner's licence, such learner's licence shall be cancelled forthwith. The person whose learner's licence has been cancelled shall be eligible for re-issue of fresh Learner's Licence on production of a certificate of learning to drive from a recognised school or establishment.

The validity of negative points will be for 24 months. The highest negative points are for drunk driving by the drivers of passenger-vehicle like buses, cabs, autos, followed by 4 points to those driving personal cars for drunk driving and 3 points for drunk driving by those on two-wheelers.

Helmet and seat belt violation will get a point each. However, motorists can reduce the tally by three negative points by undergoing defensive training course or motor vehicle accident prevention course from an institution recognised by the Transport Department of the Government. However, this facility shall be restricted to two times in a continuous period of two years.
