Karti Chidambaram told to move Delhi HC
Chennai: In a setback to Karti Chidambaram, who challenged the summons issued by CBI, directing him to appear before it, in connection with a case relating to alleged misuse of his position as the son of the then finance minister and influenced Foreign Investment Promotion Board to prevent any punitive action against the INX group for violating FIPB norms, Madras high court has directed him to approach Delhi high court.
Passing orders on the petitions filed by Karti Chidambaram, Justice P. Velmurugan said though the petitions are maintainable and this court has territorial jurisdiction, in the interest of justice in order to avoid conflicting view in case any other parties approaches Delhi high court or Mumbai high court for the same relief, this court is inclined to adopt doctrine of forum convenience.
“In the result, the registry is directed to return all the papers filed before this court to the parties for enabling them to approach the Delhi high court, which has superintendents over the Special court for CBI cases in Delhi,” the judge added.
The matter relates to an FIR filed against Karti and INX Media along with eight others for the alleged irregularities in the FIPB clearance given to the media house for foreign direct investment in 2007. The investigating agency had alleged that the FDI proposal of the media house was fallacious but Chidambaram had cleared it.
