Madras High court refuses to stay Simbu's movie

Zahir failed to return the promissory notes issued by him after the repayment, claiming they have been taken by Ramesh.

Chennai: The Tamil film AAA (Anbanavan, Asaradhavan, Adangadhavan), starring Simbu, will hit the screen tomorrow as scheduled as the Madras high court has closed an application, which sought to restrain the producer of the film from handing over the KDM (Key Delivery Message) of the film to UFX Ventures and Qube Cinema Technologies, who in turn should not release the content of the film to any of the theatres under their franchise.

Justice V. Parthiban closed an application arising out of a suit filed by M. Ramesh, engaged in the film industry rendering professional services by liaisoning /coordinating with financiers, actors and other related jobs.

“In view of the affidavit of undertaking filed by Michael Rayyappan, producer of the film, the application is closed, directing him to furnish a bank guarantee for Rs 25 lakh as undertaken by him on or before June 30, 2017. It is made clear that this order is passed without prejudice to the rights of the parties, which can be decided in the suit”, the judge added.

In his affidavit of undertaking, in respect of the application, the producer undertook not to alienate the property situated with land and building at Adambakkam village admeasuring 1,417 sq.ft, valued at Rs 1 crore or above.

Originally, Ramesh filed a suit to restrain the producer and Global Infotainment from in any way breaching the terms of the memorandum of understanding dated February 25, 2016, thereby prejudicing his interest.

Denying the allegations made by Ramesh, Michal Rayappan said Ramesh is only a financial broker and had not entered into any memorandum of understanding with him in regards to the production of this movie. He agreed to have borrowed money from Zahir, a person introduced by Ramesh, however, Zahir failed to return the promissory notes issued by him after the repayment, claiming they have been taken by Ramesh.
