Tribunal orders attachment of MTC property

The MTC has failed to obey the court order even after four years.

Chennai: The Motor Accident Claims Tribunal (Small Causes Court-II), Chennai, has ordered attachment of property, including jeeps and cars, worth Rs 7.47 lakh, of Metropolitan Transport Corporation for its failure to compensate the family members of a jewellery showroom salesman killed in a road mishap caused by its bus seven years ago. The MTC has failed to obey the court order even after four years.

The matter pertains to H. Abdulla Shahib, 19, of Keezhakarai, a sales assistant in a jewellery outlet at T. Nagar.

He was travelling in an MTC bus on November 28, 2009. When the incident occurred, he was proceeding from Triplicane to T. Nagar.

The bus driver, drove the vehicle in a rash and negligent manner. When the vehicle halted near T. Nagar flyover, the youth attempted to alight through the front door. As he was stepping out, the driver started the bus with high speed. Abdulla fell down from the bus and was run over by the rear wheel, causing injuries. He died in a hospital.

His parents, A. Hameed Farook and Chithikathega and his brother Sadam Hussain, filed a petition before the tribunal seeking a compensation of Rs 9 lakh.
On March 26, 2012, tribunal judge V. P. Ravindran ordered the managing director, MTC, to pay a compensation of Rs 5.34 lakh to petitioners. Counsel for petitioners, M. Selvam and M. Sathyan said despite repeated pleas, MTC had not released the sum to the claimants. Hence, they approached the court.

The court registry ordered attachment of property, including jeeps and cars, worth Rs 7.47 lakh belonging to MTC. On Monday, court bailiff and staff rushed to MTC GM’s office on Pallavan Salai and commenced the attachment process. Noticing this, the transport corporation officials approached the court staff and sought time till March 7 to decide on the issue.
