Hyderabad High Court backs private medical colleges
Hyderabad: The Hyderabad High Court on Wednesday made it clear that the Presidential Order under Article 371 (D) of the Constitution of India which gives reservation to local candidates at educational institutions in Andhra Pradesh and Telangana state is not applicable to management quota seats (B-category) in private medical colleges offering MBBS and BDS courses.
A division bench comprising Justice V. Ramasubramanian and Justice Anis was dismissing the petitions of several students aspiring for admission under the management quota.
The students were challenging the action of the Association of Private Medical Managements of both the Telugu states in giving admission to students of other states.
The petitioners contended that all the seats must be given to students of AP and Telangana as per the Presidential Order.
The associations told the Court that the seats in B category will be filled on merit as per ranking obtained in NEET and any students from India can apply.
When the bench sought the response from both the governments, they informed the Court in unequivocal terms that the Presidential Order is not applicable to B category seats in private medical colleges.
While considering the statements of both the governments, the bench pointed that the Presidential Order speaks about institutions which are under control of the state government s. These private colleges cannot be termed as institutions that are under the control of the government.
